BACKGROUND

Managing director of EnableOrg, workplace healthy workplace and business optimisation service. DO.NOT.USE. 1 star is far too generous. Alexy, Muli Mobile owner and director is being taken to court. And has a complaint filed with the Commerce Commission. His response to this was literally "I have instructed our lawyers to respond in the most stern way possible." If you DO NOT value your time, your money, your business, this guy is for you. Time is money, for any competent business owner. His workers are based out of India and Pakistan, something that is not on the website, his T&Cs, or anywhere else. I only found out by chance, halfway through the build.

So if you don't value your IP being at risk of breach outside NZ where you won't have a chance in hell of protecting it, again, this guy is for you. He states "your demand for a NZ-based developer. Your request is outside the scope of our contract and is declined." He tells you his one sided NDA protects you. Good luck trying to enforce or argue that in a country that isn't NZ, where your work will be going. If that was true and practical, every country would not require you file you IP in each country individually. I also pointed out that time differences would contribute to delays and said "When we are sleeping they are working". Doesn't occur to him that while we are working they are sleeping.

Do not sign this guys T&Cs. It has a clause 'that times may vary'. Any reasonable person things, fair enough, a week or two out may be reasonable. Alexy has signed a contract to deliver our app within 4 months, with this clause. It is coming on 10 months and he still holding our IP and development hostage. He tried to pin this extensive extension on some additions to the scope, which do not account for 150% extension. He keeps unilaterally extending the delivery. his response "completion by a certain date is also not in the scope of our contract."

He didn't show any evidence of work being done on the app for 10 weeks but kept invoicing to the tune of $56000 fortnightly. When I said I wasn't paying any more invoices he said he was charging 9% penalty for unpaid invoices and stopping work on the app till invoice was paid. Again, we hadn't seen any work for 10 weeks, despite numerous requests for it. He sent an email saying he had stopped work till invoices were paid. I had to send a letter of demand from our lawyer, an extra several $thousands, just to get him to do his job.

Industry norm is have 2 weekly meetings to show or confirm where on the project work has progressed to. Tried to send in auditors, to assess work that was paid for that IP I own, he denied access and stated that till delivery and full payment was received he wasn't showing anyone anything. Whilst he kept moving the delivery date to his suitability. Without discussion. Repeatedly. Whilst demanding invoices at $13804 a fortnight be paid. Or else pay 9% penalty and stop work on app. His website also has testimonials from big brands.

That all sound like they were written by the same person. And no name or position description or branch to verify for legitimacy. He also thinks you answer to him, though you are the paying client, and will only send you times to verify the work you are paying substantial money for suited to his India based developer, on occasions he isn't avoiding showing you any progress at all, because it isn't happening in even the remote timeline to the contract you signed with clauses specifically written to allow him coercive unilateral operations.

Even though I verified a standing appointment with his developer, he changed it to stipulate times that I had already said I was committed elsewhere, his response "You missed the opportunity for a demo last week claiming you were not available for any of the 18 time slots we proposed (all India slots). Yet you did have time to write a lengthy and threatening email I received at 4.33pm on Friday -- that time being at one of the slots we proposed and you declined. It seems you were not available for a productive meeting at 4pm or 4.30pm on Friday." Use this guy Alexy and Muli Mobile company at your peril.

Build and web app. Alex insisted he done similar projects before. He has lied throughout to his experience and capability.

no access or oversight given till end of build, that was extended over 150% in delivery, without discussion, money extorted when objections raised. They were completely incompetent and negligent. Extremely poor communication. No professionalism
